For this Privacy Policy, "user," "you," and "your" mean you (an Executive, Consultant, Developer, Technology Professional, or representative of a company requesting referrals) as a user of our Platform or Digital Service.

If you do not agree with this Privacy Policy or our Terms and Conditions, do not use any of our Digital Platforms (Systems, websites, third-party partners' websites or systems, software, Apps, fill-in forms, send a form, or send CVs, attachments, or via a link) and do not access or use any of our services.

- Type of tasks sought

All the administrative information needed to draw up a contract (bank details, CPF, and other necessary information)

All this information is not required at the time of registration; however, we invite you to communicate any information that could increase the efficiency of our services and improve the proposal of assignments tailored to your profile.

4. How we collect your data

The first part of the data is collected during your online registration. Most of the information is collected through the form you fill out online, when you send in your CV, by telephone, or in face-to-face interviews with our consultants. Your LinkedIn profile and other social media can also serve as a resource for our databases. We collect any professional feedback from the client company in the event of an assignment.

We also collect data when you subscribe to Penguins for Goodnewsletters or social media (LinkedIn, Instagram).

 

5. Purposes for which we use your data

The information collected directly by Penguins for Good or through third parties is processed for the following purposes: 

- Analyze your profile to determine whether it meets one of our client's needs.

- To put you in touch with our clients about a job opportunity or an assignment.

- If you agree, we will contact you about future opportunities of interest.

- Present your profile to our clients.

Such data processing is considered as follows: 

- Partly necessary, in particular, to comply with pre-contractual measures to analyze your profile to determine whether a task suits your profile.

- Partially necessary, based on Penguins of Good's legitimate interest in presenting interesting candidate profiles to clients.

Collecting your data also allows us to adapt our offer in the best possible way so that any proposed task matches your skills and aspirations. We may also carry out satisfaction surveys and other statistical studies.

Finally, certain information may be used to suggest that you take part in specific events deemed appropriate to your profile and to send you newsletters or messages.

Data processing operations are based on Pinguins do Bem's legitimate interest in improving its services and the customer experience, as well as for commercial purposes.

 

6. How long we keep your data

We will keep your data as long as necessary to achieve the purposes for which it was collected and processed as described above.

If one of our clients selects your profile, we will keep your data for the duration of the assignment and until the authorized deadline, after which it will be deleted.

If you are eventually left without an assignment, we will keep your data for 24 months from your application unless you wish otherwise.

After this period, your data will be archived for 5 (five) years to establish, exercise, or defend legal claims.

 

7. Who has access to this information

We are committed to keeping this information strictly confidential. Only the following parties are entitled to access your data: 

- Employees of Penguins for Good for whom access to your information is required.

- Penguins for Good partner companies only if the provision of their services requires access to your data (IT maintenance, compliance checks, etc.). They do not have the right to collect your data.

- Companies (Clients) looking for talent (Consultants, Developers, Technology Professionals, and others) for whom your profile matches their needs.

- These third parties are subject to a confidentiality policy about us.

The digital platform (systems, websites, partners, third-party websites or systems, software, apps, forms, attached files, and sent links) uses cookies. Cookies allow us to personalize content and ads, provide social media functionality, and analyze traffic.

9. Applicable Law and Dispute Resolution

In the unlikely event that we end up in a legal dispute, regardless of where you live or have your Business (Client), you and Penguins for Good agree to resolve it in the courts of the city of São Paulo, State of São Paulo, Brazil, using Brazilian law.
